Article 3 – Scope
These Terms and Conditions apply to all offers made by the trader and to every distance contract concluded between the trader and the consumer.
Before the contract is concluded, these Terms will be made available to the consumer. Where this is not reasonably possible, the consumer will be informed where they can access them and that they will be provided free of charge upon request.
Where a contract is concluded electronically, these Terms may be provided in a format that allows the consumer to store them on a durable medium.
If additional product or service-specific terms apply, the consumer may rely on the provision most favourable to them in case of conflict.
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Article 4 – The Offer
All offers are non-binding and subject to change.
The trader reserves the right to amend or withdraw any offer at any time.
Product descriptions are accurate and sufficiently detailed to allow proper assessment. Images are representative; however, colours may vary depending on screen settings.
Obvious errors or mistakes do not bind the trader.
Each offer includes clear information regarding:
-
The price (excluding import duties and taxes where applicable);
-
Delivery charges (if applicable);
-
Payment and delivery methods;
-
The right to cancel;
-
The validity period of the offer;
-
Any applicable conditions;
-
Available sizes, colours, and materials where relevant.
Article 5 – Formation of the Contract
The contract is concluded when the consumer accepts the offer and complies with the conditions set out.
Where acceptance is made electronically, the trader will confirm receipt without delay. Until confirmation is received, the consumer may cancel the order.
The trader will take appropriate measures to ensure secure electronic transactions.
The trader reserves the right to refuse or cancel an order where there are reasonable grounds to do so, including concerns about payment or misuse.
Upon delivery, the consumer will receive relevant information, including:
-
Contact details for customer service;
-
Information regarding the right to cancel;
-
Warranty details where applicable.
All contracts are subject to product availability.
Article 6 – Right to Cancel
Consumers have the right to cancel their order within 30 days without providing a reason.
The cancellation period begins on the day after the consumer receives the goods.
The consumer must handle the goods with reasonable care and may only use them to the extent necessary to assess their nature, characteristics, and function.
To exercise the right to cancel, the consumer must notify the trader within the cancellation period via email or written communication. The goods must then be returned within a further 30 days.
Article 7 – Costs of Cancellation
The consumer is responsible for the cost of returning the goods.
Refunds will be issued within 30 days of receiving the returned goods or proof of return.
Article 8 – Exclusions from the Right to Cancel
The right to cancel does not apply to:
-
Goods made to the consumer’s specifications or clearly personalised;
-
Goods that cannot be returned for hygiene reasons once unsealed;
-
Perishable goods;
-
Sealed items such as audio, video, or software once opened;
-
Goods subject to financial market fluctuations beyond the trader’s control.
Article 9 – Price
Prices will not increase during the validity period of the offer, except for changes in VAT.
Prices may be subject to import duties, taxes, or customs charges, which are the responsibility of the consumer.
All prices are subject to typographical errors. In such cases, the trader is not obliged to honour incorrect pricing.
Article 10 – Conformity and Warranty
The trader ensures that products comply with the contract and reasonable quality standards.
Any defects must be reported within 14 days of receipt.
The warranty does not apply in cases of misuse, improper handling, or unauthorised modification.
Article 11 – Delivery and Performance
Orders will be processed and dispatched as quickly as possible, and no later than 30 days unless otherwise agreed.
If delivery is delayed or cannot be fulfilled, the consumer will be informed and may cancel the order.
Risk passes to the consumer upon delivery.
Article 12 – Duration and Termination
Consumers may terminate ongoing contracts at any time, with a maximum notice period of one month.
Automatic renewals are subject to applicable regulations and may be cancelled in accordance with the same notice period.
Article 13 – Payment
Payment must be made within 7 working days unless otherwise agreed.
The consumer must promptly notify the trader of any inaccuracies in payment details.
Article 14 – Complaints Procedure
Complaints must be submitted in writing within 7 days of identifying an issue.
The trader will respond within 14 days.
If a complaint cannot be resolved amicably, it may be referred to the appropriate dispute resolution procedures.
Article 15 – Governing Law
These Terms and Conditions and all contracts to which they apply shall be governed by the laws of England and Wales.
